Welcome to The Family Business, the world's most premium sperm donor network. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
Section 1 - Online store terms
1. Parties and Scope
These Terms govern the use of The Family Business platform by two types of users:
"Recipients" – individuals or couples seeking sperm donation;
"Donors" – individuals participating in our donor program.
All users agree to the same Terms. The platform is currently available to users in the United States. International use may be subject to additional terms and regulatory constraints.
Section 2 - General conditions
2. Eligibility and User Commitments
To use The Family Business, you must:
Be at least 18 years of age and legally competent to enter into a binding contract;
Submit truthful, complete, and up-to-date information;
Not misrepresent your identity, intentions, or eligibility to participate;
Not use the platform for unlawful, deceptive, or coercive purposes.
We reserve the right to reject or remove any user at our sole discretion.
Section 3 - Accuracy, completeness and timeliness of information, billing and account information
3. Platform Use and Account Management
Prospective mothers must submit a brief application to join. Upon acceptance, they may browse our donor catalog.
Donors are recruited and vetted off-platform before onboarding.
Donors are profiled but not named. Personal identifying information is withheld.
All donor-recipient legal agreements are drafted by our legal team.
We do not handle or store gametes or tissues. The Family Business acts as a coordination marketplace and does not operate as a clinic or tissue bank.
Section 4 - Modifications to the service and prices
4. Legal Boundaries Between Donors and Recipients
Unless expressly stated otherwise in a signed agreement:
Donors waive all parental rights, responsibilities, and claims;
Recipients retain full reproductive and parental autonomy;
The Family Business is not a legal party to parental claims or disputes but facilitates legally binding donor-recipient contracts.
Section 5 - Products or Services
5. Medical Coordination
We coordinate with licensed IVF clinics and genetic counselors, but we do not store medical records or data that fall under HIPAA.
Screening and testing occur through third-party clinical professionals.
We provide only basic medical overviews relevant to the coordination process.
Section 6 - Optional Tools
6. Refunds, Failures, and Disputes
Refunds or donor substitutions may occur under limited conditions:
If a donor is medically disqualified, the recipient may select a backup.
If a donation is unusable, we will fund the donor’s reattempt(s) until a viable sample is produced.
We disclaim responsibility for:
Pregnancy outcomes;
Misuse of donor material;
Emotional, medical, or psychological consequences of donation or resulting parenthood.
All disputes shall be resolved through confidential arbitration in the State of California, under the rules of the American Arbitration Association.
Section 7 - Third-party links
7. Export and Data Restrictions
Recipients and donors may not download, distribute, export, or repurpose donor profile data for use outside of The Family Business platform. Unauthorized use of platform content may result in account termination and legal action.
Section 8 - User comments, feedback and other submissions
8. Modifications and Termination
We may revise these Terms at any time. Continued use after changes constitutes acceptance. We may suspend or terminate any account for violations of these Terms, with or without notice.
Section 9 - Personal information
9. Ethical Use Clause
You may not use this platform for reproductive fraud, coercion, or unapproved experimentation. We reserve the right to terminate access and report such activities to relevant authorities.
We maintain ethical discretion in approving or rejecting pairings that violate our core mission: intentional, high-fidelity reproductive coordination.
